FlexOS Global Pte. Ltd. ("us", "we", or "our") operates the www.flexos.work website (the "Service").

This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Customer information when you use our Service and the choices you have associated with that data. This policy applies to all services offered by FlexOS and is integral to Our commitment to protecting the privacy of You. By using the Service, you agree to the collection and use of information in accordance with this policy.

Interpretation and Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • “Authorized User” means a named individual that: (A) is an employee, representative, consultant, contractor or agent of Customer or a Customer Affiliate; (B) is authorized to use the Service pursuant to this Agreement; and (C) has been supplied a user identification and password by Customer. Customer will be responsible for all access and use of the Service by the Authorized Users
  • Application means the software program provided by the Company downloaded by You on any electronic device, named FlexOS
  • Customer means any organization (e.g., Customer employer or another entity) or person that entered into an agreement to user our Service and therefore have access and  controls into their instance of the Services
  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to FlexOS Global Pte. Ltd., 20A Tanjong Pagar Road, 088443, Singapore.
  • Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
  • Personal Data is any information that relates to an identified or identifiable individual. In order to use the Services, Personal Data provided by the Customer directly or indirectly (invitation to access Personal Data from a Workspace, or other) are accessible by us in order to generate and/or operate our Services. 
  • Authorized Users may provide us with their Personal Data directly at instances, for example when they provide feedback or request client support or in any way communicate with us. We will not collect or use any sensitive personal data unless we have received an express consent regarding the specific data.
  • Service refers to the Application.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Collecting and Using Customer Personal Data

Types of Data Collected

Personal Data

While using Our Service, We may ask You to provide Us with various types of personal information including your Email Address, First and Last Name. This information is used to maintain your account, provide service support, and send communications regarding service updates or promotions. You can manage your preferences and opt out of non-essential communications through your account settings.

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Customer Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Customer visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Customer mobile device unique ID, the IP address of Customer mobile device, Customer mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Customer browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Services Metadata

When an Authorized User interacts with the Services, metadata is generated that provides additional context about the way Authorized Users work. For example, we may log the channels, people, features, content and links you interact with, the types of files shared and what Third Party Services are used (if any).

Log data

As with most websites and technology services delivered over the Internet, our servers automatically collect information when you access or use our Websites or Services and record it in log files. This log data may include the Internet Protocol (IP) address, the address of the web page visited before using the Website or Services, browser type and settings, the date and time the Services were used, information about browser configuration and plugins, language preferences and cookie data.

Report data

When you or Customer participates and/or generates the Service, we collect all supplied or relative information in view to produce and supply you and/or customer with results in the form of a Report. Reports are archived and are retrievable by Customer. Reports may also be used for research, statistical purposes in order to improve Service efficiency, update our App, as well as feedback in order to create and launch marketing campaigns.

Device information

We may collect information about devices accessing the Services, including type of device, what operating system is used, device settings, application IDs, unique device identifiers and crash data. Whether we collect some or all of this Other Information often depends on the type of device used and its settings.

Location information

We may receive information from you, Customer Customer and other third-parties that helps us approximate Customer location. We may, for example, use a business address submitted by Customer employer, or an IP address received from Customer browser or device to determine approximate location in order to inline our Services with Customer current time-zone. We may also collect location information from devices in accordance with the consent process provided by Customer device.

Cookie Information

We use cookies and similar technologies in our Websites and Services that help us collect Other Information. The Websites and Services may also include cookies and similar tracking technologies of third parties, which may collect Other Information about you via the Websites and Services and across other websites and online services. You may also opt out of “third party cookies” by following the instructions provided in the Cookies Policy particulars before consenting to our use of Cookies when you visit our Websites and Services. Hotjar

We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users' experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices (in particular device’s IP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our website). Hotjar stores this information in a pseudonymized user profile. Neither Hotjar nor we will ever use this information to identify individual users or to match it with further data on an individual user. Third Party Services

Typically, Third Party Services are software that integrates with our Services, and Customer can permit its Authorized Users to enable and disable certain integrations, while other (e.g. invoicing, billing, payments’ integrations) are required for the operation of the Service therefore Customer or Authorized Users are required to use if they intend to use our Service. Once enabled, the provider of a Third Party Service may share certain information with us. Authorized Users should check the privacy settings and notices in these Third Party Services to understand what data may be disclosed to us. When a Third Party Service is enabled, we are authorized to connect and access Other Information made available to us in accordance with our agreement with the Third Party Provider. We do not, however, receive or store passwords or means of payment/ transaction details (for example credit-card numbers) for any of these Third Party Services when connecting them to the Services. Furthermore, for purposes of Due Diligence, Analytics, Client Support, Quality Control and Communication we may employ Third Party Services in view to acquire information and data, as well as Personal Data, in order to comply with our legal, contractual or client service and support obligations as well as improve our product. Such services may include (list non-exhaustive) Google Analytics, Zoho Invoicing, Clearbit services, Wirecard Payments, Intercom, etc. For a complete list of Third Party.

Use of Customer Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.
  • To manage Customer Account: to manage Customer registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.
  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
  • To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
  • To manage Customer requests: To attend and manage Customer requests to Us.
  • For business transfers: We may use Customer information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
  • For other purposes: We may use Customer information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and Customer experience.

We may share Customer personal information in the following situations:

  • With Service Providers: We may share Customer personal information with Service Providers to monitor and analyze the use of our Service, to contact You.
  • We may share Customer data with trusted third parties, including those who assist Us in operating Our Services, conducting Our business, or serving Our users, so long as those parties agree to keep this information confidential. We also share information when it helps Us comply with legal requirements, enforce Our policies, or protect our rights, property, or safety or that of others.
  • For business transfers: We may share or transfer Customer personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates: We may share Customer information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With business partners: We may share Customer information with Our business partners to offer You certain products, services or promotions.
  • With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
  • With Customer consent: We may disclose Customer personal information for any other purpose with Customer consent.

Customer Access

Owners, administrators, Authorized Users and other Customer representatives and personnel may be able to access, modify or restrict access to Other Information. This may include, for example, your employer using Service features to export activity logs and reports.

Data Retention

The Company will retain Customer Data in accordance with a Customer’s instructions, including any applicable terms in the Customer Agreement and Customer’s use of Services functionality, and as required by applicable law. Depending on the Services plan, You have specific rights regarding the access and control of your personal data, including the right to access, rectify, or erase your personal data, or restrict its processing. Furthermore, if You are subject to the General Data Protection Regulation (GDPR), You have the right to object to processing, request data portability, and withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

Data Deletion

The deletion of Customer Data and other use of the Services by Customer may result in the deletion and/or de-identification of certain associated Other Information. The Company may retain Other Information pertaining to you for as long as necessary for the purposes described in this Privacy Policy. This may include keeping Customer Other Information after you have deactivated Customer account for the period of time needed for The Company to pursue legitimate business interests, conduct audits, comply with (and demonstrate compliance with) legal obligations, resolve disputes, enforce our agreements, archiving, statistical or research purposes. Our Service, or We are legally obligated to retain this data for longer time periods.

How Can Customer Delete Information Kept by The Company?

Customer shall decide to delete the account by emailing hi@flexos.work.

If Customer terminate the Account, any association between the Account and information the Company store will no longer be accessible through the Account. However, any public activity on the Account prior to deletion will remain stored on the Company servers and will remain accessible to the public.

Data Transfer

Customer information, including Personal Data, is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Customer state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Customer jurisdiction.

Customer consent to this Privacy Policy followed by Customer submission of such information represents Customer agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that Customer data is treated securely and in accordance with this Privacy Policy and no transfer of Customer Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Customer data and other personal information.

Disclosure of Customer Personal Data

1. Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Customer Personal Data may be transferred. We will provide notice before Customer Personal Data is transferred and becomes subject to a different Privacy Policy.

2. Law Enforcement

Under certain circumstances, the Company may be required to disclose Customer Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

3. Other Legal Requirements

The Company may disclose Customer Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend the rights or property of the Company
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of Users of the Service or the public
  • Protect against legal liability

Security of Customer Personal Data

We employ industry-standard security measures to protect your data, including encryption, firewalls, and secure server facilities. Our Data Retention Policy ensures that your personal data is only retained for as long as necessary to fulfill the purposes for which it was collected, in compliance with Our legal obligations and operational requirements. The security of Customer Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Customer Personal Data, We cannot guarantee its absolute security.

Your Data Protection Rights 

If You are a resident of the European Economic Area (EEA), You have specific rights under the General Data Protection Regulation (GDPR). These rights include the ability to access, correct, delete, or transfer your personal data. Additionally, you have the right to object to certain processing activities and the right to withdraw consent at any time. 

For California residents, the California Consumer Privacy Act (CCPA) grants specific rights regarding your personal information. You have the right to request disclosure of the categories and specific pieces of personal information We collect about You, to request the deletion of your personal data, and to opt-out of the sale of your personal information.

Children’s Privacy

Our Service does not address anyone under the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of 18. If You are a parent or guardian and You are aware that Customer child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 18 without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Customer information and Customer country requires consent from a parent, We may require Customer parent’s consent before We collect and use that information.

Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party’s site. We strongly advise You to review the Privacy Policy of every site You visit, to understand their data handling practices.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Changes to this Privacy Policy

We will notify you of any changes to Our Privacy Policy via email and/or a prominent notice on Our Service, before the changes become effective and update the 'Last updated' date at the top of this policy. We encourage You to review Our Privacy Policy periodically for any changes.
